3 Law:: set-off <[‘bill of particulars’ is] a specific statement by a plaintiff to a defendant of what he seeks to recover by his action, or of a defendant’s set-off • counterclaim • cross-action • cross-demand : where a person against whom a demand is made by another, in his turn makes a demand against that other, these mutual demands are called “cross-demands.” A set-off is a familiar example • cross claim : a claim that arises between codefendants or coplaintiffs in a case and that relates to the subject of the original claim or counterclaim. – Also termed cross-action • cross-complaint : a defendant or cross-defendant may file a cross-complaint setting forth either or both of the following: (a) Any cause of action he has against any of the parties who filed the complaint against him. (b) Any cause of action he has against a person alleged to be liable thereon, whether or not such person is already a party to the action, if the cause of action asserted in his cross-complaint, (1) arises out of the same transaction, occurrence, or series of transactions or occurrences as the cause brought against him or (2) asserts a claim, right, or interest in the property or controversy which is the subject of the cause brought against him.
