brotherhood; covenant of brotherhood – (civil law) enter, ~ing into a covenant of brotherhood with s.o. (sura Anfâl, verse 72) : Among pagan Arabs, and for a short time after the advent of Islam, inheritance would be created on عقد محالفت (a covenant between two or more persons based on their oath of intimate allegiance to each other). The covenant was also styled عقد موالات . Later on, it was decreed that one requisite for inheritance would be the voluntary emigration to a Muslim state or society of a non-Muslim living in a non-Muslim society or nation (ارث به هجرت : inheritance as the result of a non-Muslim’s emigration to the Muslim nation). Prophet Mohammad united the ansâr and muhâjerin in the covenant of اخوت (or مؤاخات ) on the basis of which a Muhajer would inherit not his non-Muslim kin but an Ansâri upon the latter’s demise. Later on, and upon revelation of verse 6 of sura احزاب (Ahzâb) inheritance as the result of a non-Muslim’s emigration to the Muslim nation, or inheritance upon covenant of brotherhood was abrogated.
